2. Service Description

FreshFruit (freshfru.it) is a community-driven platform that allows users to share fruit and produce quality reports from retail stores. Users can photograph, rate, and report on the freshness of produce purchased in stores.

The service is currently in pilot phase and is provided free of charge. Features, availability, and terms may change as the platform evolves.

3. Eligibility

The service is available to anyone without registration. No account or personal data is required to use the pilot version. By using the service, you confirm that you are at least 16 years old. Persons under 16 may only use the service with the consent of their legal guardian.

4. User Content

By submitting a report (including photos, ratings, and text), you agree to the following:

• You retain full ownership of the photos you upload
• You grant NOAH Natural Products s.r.o. a worldwide, non-exclusive, royalty-free license to display, reproduce, and distribute your content on the FreshFruit platform and related promotional materials
• Your reports must be truthful, based on your actual purchase experience
• You must not upload photos containing identifiable faces of other people without their explicit consent
• You confirm that the photo depicts produce you personally purchased

5. Prohibited Use

The following activities are strictly prohibited:

• Posting false, misleading, or defamatory reports about any store or product
• Uploading offensive, obscene, or inappropriate content
• Attempting to manipulate store ratings or freshness scores
• Using automated tools (bots, scrapers) to interact with the service
• Interfering with or disrupting the service infrastructure
• Using the platform for commercial advertising or spam

We reserve the right to remove any content that violates these terms without prior notice.

6. Intellectual Property

The FreshFruit name, logo, design, and all platform content (excluding user-generated content) are the intellectual property of NOAH Natural Products s.r.o. and are protected under applicable Czech and EU intellectual property laws.

The aggregated freshness scores, store rankings, and derived data generated by the platform remain the property of NOAH Natural Products s.r.o.

7. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the extent permitted by applicable law.

• FreshFruit displays user-generated content. We do not verify or guarantee the accuracy, completeness, or reliability of any report
• Freshness scores and store ratings are calculated from community reports and may not reflect current conditions
• We do not guarantee uninterrupted or error-free operation of the service
• Store information (names, addresses) is provided for reference only and may not be fully accurate

This disclaimer does not affect your statutory rights as a consumer under Czech law (Act No. 634/1992 Coll., on Consumer Protection) or EU consumer protection regulations.

8. Limitation of Liability

To the maximum extent permitted by applicable law, NOAH Natural Products s.r.o. shall not be liable for:

• Any indirect, incidental, special, or consequential damages arising from the use of the service
• Purchase decisions made based on reports or scores displayed on the platform
• Loss of data or disruption of service
• Content posted by other users

This limitation does not apply to liability that cannot be excluded or limited under Czech law (Section 2898 of Act No. 89/2012 Coll., Civil Code).

9. Content Moderation

We reserve the right to review, edit, or remove any user-generated content at our discretion. Reports that violate these terms, contain inappropriate content, or are flagged by the community may be removed without notice.

10. Consumer Rights & Dispute Resolution

As a consumer in the Czech Republic or EU, you have rights under consumer protection legislation that cannot be waived by these terms.

11. Governing Law

These terms are governed by and construed in accordance with the laws of the Czech Republic, in particular Act No. 89/2012 Coll. (Civil Code) and Act No. 634/1992 Coll. (Consumer Protection Act).

Any disputes arising from these terms shall be resolved by the competent courts of the Czech Republic. For consumers residing in the EU, this does not affect your rights under mandatory consumer protection legislation in your country of residence.

12. Changes to These Terms

We may update these terms from time to time. Significant changes will be communicated via the website. Continued use of the service after changes constitutes acceptance of the updated terms.
